Civil Traffic Violations

You have the following rights if you have been charged with a civil traffic offense:  The right to hire an attorney, the right to have a trial, question witnesses at the trial, present your evidence and witnesses, be presumed not responsible unless the State can prove it's case against you by a preponderance of the evidence.

If you have received a civil traffic violation, you should have also received an envelope.  Enclosed in the envelope is an "Information Card". The information card will explains the following options.

Option One:

Attend a Defensive Driving Program.  If you qualify, the following information applies to only one eligible charge.  When you complete the course, you have no fine to pay, you do not have to appear in court, and the eligible charge will be dismissed.  

If you do not have an "Information Card" to guide you on attending a Defensive Driving Program. Please contact the court which has jurisdiction over your case to attend Defensive Driving Class.

 Option Two:

Admit the offense(s) on the ticket in three different ways.  a)  Follow the instructions for paying the fine by mail, please click on the appropriate court's link and follow the instructions for Paying the Fine on the Information Card link;  b)  pay the fine at the court office's counter between the hours of 8:00 am and 5:00 pm, Monday through Friday; or c)  appear before the Judge on the date and time indicated on your ticket.

Option Three

Deny the offense on the ticket and request a hearing date.  You may do this in person or by mail.  Click on the appropriate court's link and follow the instructions for Denying the Offense on the Information Card link.

NOTICE:

If you fail to complete one of the three options above on or before the court date shown on a civil traffic ticket, the court will enter a default judgment against you. A civil sanction will be imposed, and your driver’s license will remain suspended until the civil sanction and late fees are paid to the court.

CAN’T PAY THE FINE IN FULL?

A payment schedule may be arranged at the Court Collections Office on your court date, or you may make your request in writing.  Click on the appropriate court's link and follow the directions for Paying Your Fine By Mail.  A fee of $20.00 is assessed for arranging a payment schedule (ARS 12-116).
